"With the advocate weakened by a smaller budget, the system of checks and balances between rate payers and companies that control the flow of electricity and natural gas would be compromised. If anything, rate payers need a vigorous defender more than ever as lawmakers attempt to deregulate and diversify Ohio's energy markets. Migden-Ostrander boasts that OCC has saved utility customers - many of them companies - nearly $55 million in the past two years. On a modest operating budget of $8.5 million a year, that means Ohioans get their money's worth from the consumers' counsel.
We appreciate the governor's conviction in trying to brighten Ohio's business climate. Clearly, the corporate community will get plenty of support from this administration. But government's obligation is to every citizen. Disabling the consumers' counsel would leave many Ohioans without a voice when they need to be heard the most. The legislature should ensure the agency remains financially healthy under the next budget."

"Any claim that the services of the consumers' counsel duplicate those of the Public Utilities Commission of Ohio is simply inaccurate … The consumers' counsel has a specific statutory responsibility to represent only residential customers. The PUCO has a different responsibility to consider and balance the needs of the utilities and the needs of the residential, commercial and industrial customers. Many times those interests conflict. The consumers' counsel has no such conflicts. Most large commercial and industrial customers are represented by some of the most effective and highest-paid legal counsels in the state. Also the utilities has high-priced legal counsel, and their fees are passed on to the customers. All the residential customers have is the consumers' counsel."

"The cost of the office (Consumers' Counsel), which is paid through the regulated rates of utilities, is modest compared to the dollars at stake in a typical case before the Public Utilities Commission of Ohio (PUCO) … Ratepayers pay for utility company lawyers… An adequately funded Consumers' Counsel helps provide balance to the process … The OCC provides review of all rate cases by experienced accountants; specialists in wholesale markets, transmission or transportation; energy efficiency and renewable energy analysts, engineers experiences in reliability issues; and a solid stable of lawyers."
